Losing a loved one is a tragic and emotional experience. A surviving spouse, children and parents of a deceased person may file a wrongful death claim on their behalf in South Carolina. Even the deceased person’s heirs may file a claim if there are no parents, spouse or children. The Horton Law Firm is a team of Greenville-based wrongful death lawyers who serve these relatives of those killed due to the fault of another.

South Carolina law defines a wrongful death as a fatality caused by “the wrongful act, neglect, or default of another.” Types of wrongful death cases are varied, and can include instances such as:

  •    Car Accidents
  •    Motorcycle Accidents
  •    Bicycle Accidents
  •    Pedestrian Accidents
  •    Boat and Jet-Ski Accidents
  •    Trucking Accidents
  •    Violence
  •    Defective Products
  •    On-the-Job Accidents
  •    On-Premises Accidents
  •    Dangerous Animals
  •    Pharmacy Errors

Time Limits – Statue of Limitations

If a loved one has been killed in an accident, contact South Carolina wrongful death lawyer Andy Arnold as soon as you can. You don’t want to run the risk of evidence lost and witnesses disappearing. In South Carolina, there’s also a statute of limitation where a wrongful death lawsuit must be filed within three years of the person’s death. In other states, however, there are different statues of limitations that can be as short as six months.

A wrongful death case can be complicated. Responsible parties can be individuals, companies and organizations, and their insurers. Damages may include financial support, such as lost wages, benefits, funeral and medical expenses, and household assistance. Pain, suffering and mental anguish can also be compensated. Where there is intentional acts or reckless conduct, punitive damages may be recovered as well.
